1. Who We Are

Thryv Marketing Solutions LLC ("Thryv," "we," "us," or "our") is a Florida-based digital marketing agency. Our principal place of business is Miami, Florida. You can reach us at hello@thryvmarketingsolutions.com for any privacy-related inquiry, data request, or complaint.

2. Information We Collect

We collect three categories of information:

• Information you submit directly through our contact forms, free-tool calculators, audit requests, or booking forms — including your name, email address, phone number, business name, website URL, and any free-text message you provide.
• Information collected automatically when you use this site, including pages visited, time on page, referring URL, approximate geographic location (city / region level via IP), device type, browser, and basic interaction events (clicks on key buttons and links). This is collected through our analytics provider, PostHog.
• Information from third-party platforms if you become a client and grant us access to your Google Business Profile, Google Ads, Meta Ads, website CMS, or analytics accounts. We process that data on your behalf to deliver the services you have engaged us to provide.

3. How We Use Your Information

We use the information described above to:

• Respond to your inquiries and deliver the services you request
• Send service-related communications, reports, and operational notices
• Improve the performance, content, and usability of our site, tools, and services
• Send marketing communications, only if you have opted in or are an existing client
• Comply with legal obligations and enforce our terms

We do not sell, rent, or share your personal information with third parties for their independent marketing purposes.

4. Cookies and Analytics

We use PostHog for product and usage analytics. PostHog sets cookies and local-storage entries to track page visits and aggregated interactions. We use this data solely to understand how visitors use the site and to improve performance and user experience.

You can opt out of analytics in three ways:

• Click Decline on our consent banner when you first visit the site
• Visit any page on this site with ?ph_optout=1 appended to the URL — this sets a permanent local opt-out
• Use a browser extension that blocks analytics scripts (uBlock Origin, Privacy Badger, etc.)

We do not use session-replay recordings, behavioral retargeting pixels, or third-party advertising trackers on this site.

5. Email Communications and CAN-SPAM

If you submit a contact form, request a free proposal, or subscribe to updates, you may receive emails from us. Every marketing email includes a working unsubscribe link and our business address. You can opt out at any time. Operational emails to active clients (invoices, reports, service notices) are not promotional and are not subject to unsubscribe.

6. Data Retention

We retain contact-form submissions and client records for as long as is reasonably necessary to provide services, maintain accurate business records, and comply with legal obligations. Inactive prospect inquiries are typically retained for up to 24 months. Client engagement records are retained for the duration of the engagement plus up to seven years thereafter for tax, audit, and dispute-resolution purposes. You may request earlier deletion of your personal data; we will honor such requests except where retention is required by law.

7. Third-Party Service Providers

We use the following third-party services, each of which has its own privacy policy that governs the data it collects on our behalf:

• PostHog — usage analytics
• Web3Forms — contact form processing
• Cloudflare — site hosting, CDN, and DDoS protection
• TidyCal — appointment booking
• Google Workspace — email and document storage
• OpenAI / Anthropic — when AI features process submitted content (clients only; never raw prospect data)

These providers act as data processors on our behalf and are contractually limited to using the data only to deliver services to us.

8. Your Privacy Rights

You have the right to:

• Access — request a copy of the personal information we hold about you
• Correct — request correction of inaccurate information
• Delete — request deletion of your personal information, subject to legal retention requirements
• Object or restrict — object to specific processing or request restriction
• Data portability — receive your data in a portable format where applicable
• Withdraw consent — withdraw consent previously given for processing

9. California Residents (CCPA / CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act as amended by the CPRA:

• Right to know the categories and specific pieces of personal information we have collected about you in the prior 12 months, the sources, the business purposes, and the third parties with whom we have shared it
• Right to delete personal information we have collected, subject to legal exceptions
• Right to correct inaccurate personal information
• Right to opt out of sale or sharing — we do not sell or share personal information for cross-context behavioral advertising, but you may submit a verifiable request to confirm this status
• Right to limit use of sensitive personal information — we do not collect or use sensitive personal information
• Right to non-discrimination for exercising any of the above

In the prior 12 months, we have collected the following categories of personal information: identifiers (name, email, phone), commercial information (business name, services requested), and internet activity (analytics data described above). We have not sold or shared personal information for cross-context behavioral advertising.

10. European Visitors (GDPR)

If you access this site from the European Economic Area, United Kingdom, or Switzerland, our legal basis for processing your personal data is:

• Consent — for marketing communications and non-essential analytics cookies (you may withdraw consent at any time)
• Legitimate interests — for operating, securing, and improving the site, where these interests are not overridden by your fundamental rights
• Performance of a contract — for delivering services to clients
• Legal obligation — for compliance with applicable laws

You have the rights described in Section 8 above, plus the right to lodge a complaint with your local data protection authority. International transfers of your data to the United States are conducted under standard contractual clauses where required.

11. Other State Privacy Laws (Virginia, Colorado, Connecticut, Utah, Texas, and others)

Residents of states with comprehensive privacy laws have rights substantially similar to those described in Sections 8 and 9, including access, deletion, correction, opt-out of sale or targeted advertising, and appeal of denied requests. 12. Children's Privacy (COPPA)

This site is directed at businesses and adult professionals. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it promptly. Parents or guardians who believe their child has provided information should contact hello@thryvmarketingsolutions.com.

13. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit (HTTPS), access controls on internal systems, and contractual security requirements with our service providers. No system is fully secure, and we cannot guarantee absolute security.

14. Data Breach Notification

In the event of a confirmed data breach affecting your personal information, we will notify you and the appropriate regulatory authorities within the time frames required by applicable law (typically within 72 hours of discovery for serious breaches). Notification will describe the nature of the breach, the categories of data affected, mitigation steps taken, and recommendations for protecting yourself.

15. Client Data and Our Role as Data Processor

When you engage us as a service provider, we act as a data processor for personal data about your customers, leads, reviewers, and ad audience that we process while delivering services to you. You remain the data controller for that data. Our processing is governed by your written services agreement, which acts as our Data Processing Addendum. We process such data only for the purposes you instruct, do not sell or share it, and return or delete it at the conclusion of our engagement upon your request.

16. AI and Automated Processing

Some of our internal tools use AI services (including OpenAI and Anthropic) to draft content, analyze data, and generate reports. When AI is used to process information you submit, the third-party AI provider is contractually prohibited from training on or retaining your data beyond the immediate processing window. We do not make significant decisions about you based solely on automated processing without human review.

17. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted at the top of this page for at least 30 days. Continued use of the site after changes constitutes acceptance.
